Overview
The Supreme Court of India is playing a part in how the country is run these days. This is really clear in areas like making sure the government is accountable laws, about things and protecting the environment. The Supreme Court of India is doing this because it has to according to the constitution and also because the legislative and executive parts of the government are not doing their jobs well. The Supreme Court of India is taking on responsibility.
The Function of Judges in Environmental Governance
The environment in India has been shaped by the Supreme Court. The Supreme Court of India has made sure that the rules to protect the environment are followed strictly. This is done by keeping an eye on things like controlling pollution, regulating mining, saving forests and managing the environment in cities. The Supreme Court of India wants to make sure that the environment is protected so it uses ideas like being careful and planning for the future. The Supreme Court of India also thinks about the people and the Earth when it makes decisions. Sometimes the government does not want to do something to help the environment. The Supreme Court of India tells them they have to especially when the environment is getting worse and it is hurting peoples health and the future of India. The Supreme Court of India is very important for the environment, in India.
Increasing Monitoring in Digital Regulation
The Court plays a part in how we govern the internet and technology. As technology moves forward fast the laws are not keeping up. This means the Court has to deal with a lot of issues. The Court is looking into things like keeping peoples information safe stopping bad things from being online fake news and fake videos that look real. The Court is trying to figure out what is okay and what is not okay when it comes to the internet. The Court wants to make sure people can still say what they think. Also that everyone is safe and respectful. The Court is doing this because there are not rules yet for how to govern the digital world. The Court is working to find a balance, between being free to express ourselves and staying within the limits of what’s acceptable.
Increasing Administrative Responsibility
- The Supreme Court has made accountability much stronger through judicial review.
- The Court makes sure that the law is fair and that everything is out in the open.
- It does this by checking if the people in charge are making decisions if the rules are working properly and if the right steps are being taken.
- The Supreme Court interventions have made sure that administrative actionsre fair, reasonable and not biased which is what the constitution says they should be.
- The Supreme Court has upheld the norms of fairness, reasonableness and non-arbitrariness in administrative actions, which is very important for the Supreme Court and, for administrative actions.
Judicial Overreach Concerns
The courts have helped fill some gaps in the way the country is run but if we rely on them too much it could be bad for the separation of powers. For governance to work in the long term we need the executive institutions to be competent and the legislatures to be receptive the governance cannot always depend on the courts to oversee everything. The separation of powers is important. The courts should not be the only ones, in charge of governance.
In conclusion
The Supreme Court’s expanding authority underscores a period of change in India’s political system. Although judicial activism has served as a stabilising influence, improving executive power, regulatory expertise, and democratic accountability are ultimately necessary for sustainable governance.
