Aravalli Ruling, Environmental Governance and Judicial Responsibility

The Supreme Court has said yes to the governments rule to protect the Aravalli hills with a 100-metre zone. This has made people worry again about how the environment’s being taken care of and if the courts are doing enough to make sure we have sustainable development. The Aravalli hills and the environment are very important. People are concerned, about the future of the Aravalli hills.

We need to find a way to make sure the earth is okay and that people have what they need to live. Sustainable development is about making sure we do not hurt the earth when we are trying to make life better for people. So we have to balance taking care of the earth and making sure people have what they need. This is what sustainable development is really about it is about balance, between taking care of the earth and meeting the needs of people for development.

The judicial system has a role to play in protecting the environment. This is because environmental rights are covered under Article 21 of the Constitution. The main job of the judiciary is to make sure that these environmental rights are protected. When we talk about responsibility we are talking about the responsibility of the judiciary to protect the environment and make sure that peoples environmental rights are not violated. Judicial responsibility includes protecting rights, under Article 21 of the Constitution.

The courts have really helped the environment in the past. They made some decisions that protected the environment using ideas like the public trust and the precautionary principle. These decisions have made a difference, in how we take care of the environment. The public trust and the precautionary principle are important because they help keep the environment safe.

Concerns

If we do not follow the rules that protect the earth the earth will get damaged faster. This is because the rules are in place to keep the system safe. When these protection norms are reduced ecological degradation happens quickly and that is very bad for the earth and for us. The ecological system is what keeps our air and water clean so we need to make sure we do not hurt it. Reduced protection norms are a problem, for the ecological system.

When the courts give much power to the people in charge of the government it can hurt the environment. The environment needs to be protected. The courts should not let the government do whatever it wants. This is a problem because the government is supposed to keep the environment safe and the courts are supposed to make sure they do that. Environmental safeguards are excessive judicial deference, to executive discretion can weaken these environmental safeguards.

Long-term environmental costs risk being overlooked for short-term gains.

Way Forward

  • Apply the precautionary and inter-generational equity principles consistently.
  • Base judicial decisions on independent expert assessments.
  • Strengthen enforcement and monitoring mechanisms.
  • A proactive judiciary, guided by ecological science, is essential for credible and sustainable environmental governance.
